Course Summary

In addition to providing a critical platform for understanding their past and present institutional successes and failures with a view to evaluating best practices for future outcomes, the course aims to help students have a firm appreciation of the specific patterns and applications of law and policy in the energy sector. The course also critically examines the continuing relevance and role of antitrust/competition in the market place. It focuses on examining the changing fortunes of countries pursuant to specific approaches and patterns of implementing market and economic reforms.

Specific topics include: Introduction to Energy Policy and Regulation; Overview of Regulation and Sector/Economic Restructuring; Vertically Integrated Network Industries and Regulation of Natural Monopoly; Market Failures; Restructuring – Rationale and Approaches and their Evaluation; Alternative Forms of Regulation and Governance of Restructured Industries; Pricing Policies; Current Issues Related to Restructuring and Regulation; Regulatory Choices; Regulatory Alternatives; and Regulatory Impact Analysis: Simulating Chosen Options and Citing Improvements.

The course also critically examines the continuing relevance and role of antitrust/competition in the market place. It focuses on examining the changing fortunes of countries pursuant to specific approaches and patterns of implementing market and economic reforms. Topics to be considered include: Introduction to Competition Law; Cartels and Anti-Competitive Agreements; The Law of Dominance; and Abuse of Market Power. Specific topics include: Intellectual Property Rights and Competition Law; Mergers, Joint Ventures and Other Beneficial Horizontal Arrangements; Extraterritoriality, International Aspects and Globalization.

Using case studies and practical scenarios, the course further examines the Cross-jurisdictional considerations which provide critical building blocks in understanding better strategies of market governance and antitrust/competition in the market place. It addresses topics such as Intellectual Property Rights and Competition Law; Mergers, Joint Ventures and Other Beneficial Horizontal Arrangements; Extraterritoriality, International Aspects and Globalization.
